What Is the EU Pay Transparency Directive?

The EU Pay Transparency Directive (2023/970) is a landmark regulation adopted in 2023. EU member states were required to transpose it into national law by June 7, 2026, and the European Commission says the rules are now taking effect across the EU. It aims to close the gender pay gap by giving employees the right to pay information and requiring employers to report on pay gaps.

The 5% Rule

A joint pay assessment is triggered when the average pay gap is at least 5% in a category of workers, cannot be justified by objective, gender-neutral factors, and has not been remedied within six months of the pay report. The reporting duties apply to employers with 100+ workers on the directive's phased schedule. This is the most significant enforcement mechanism in the directive.
